It always pisses me off that in the comments of every single Kno and Cunninlynguists song somebody asks what he sampled and some other asshole usually tells it. Why can’t people be happy with a good song without knowing every little detail about what was sampled to make it?
I am happy CunninLynguists and Blue Scholars connected on Strange Journey Volume 2. I like Blue Scholars, listen to them a lot. And this stuff ruins it all. Maybe just turn off the comments..
thats ridiculous. seems like to me that regardless of what music a person has made in their head, in the end it may be a “sample” from their musical memory or something that influenced them to create that rhythm. there are only a finite amount of sonic patterns that appeal to the human brain, and with all the music that has been made in the world, I find it hard to believe that anything these days hasnt been influenced/sampled from something that’s been done before.
as far am i’m concerned, artists who do sample, are really breathing new life into old/obscure/unknown music that most people are not familiar with and letting them enjoy it in a new light.
Bibio isn’t a forgotten artist who is only being helped by sampling…the sampled song was released last year. I am sure there are people who check for both of them (I’m not a fan of either, but I’ve checked out both of them)..If an artist you overlap some fans with samples a main loop of your most recent album you’re still promoting, and you don’t like it, a cease and desist is pretty justified, IMO
On the other hand…Bibio and half the Warp Records roster are artists who sample themselves, which makes it bullshit. I’m sure there’s uncleared samples on Bibio’s album itself. For a sample-based artist/label to cease and desist someone for sampling them is fucked up to me…makes me not want to support Warp

I never actually thought about how underground rappers and producers would be hit by this kind of thing…Dang.
It’s not just underground rappers that get hit with cease & desist letters - they just get hit the hardest as sample clearance can be incredibly expensive.
Pharoahe Monch’s Simon Says was hit with the same problem and even though the album sold close to 250K the sample was just too expensive to clear causing Rawkus to shelve the album completely.
Dr. Dre has been hit with a few, as well as Timbaland, RZA, DJ Premier etc.
And don’t they even know Blue Scholars? How can you even want to be against a phenomenal group like that? Sabzi and Geo are some of the most honest, down to earth, cool guys out there, making great hiphop for people to enjoy. How can someone want to prevent them from doing so??
It’s not so much about “expanding” fair use, but rather successfully arguing a fair use defense in court and taking down the current court decisions as legal precedent. That’s the thing—artists in the past *have* successfully used fair use as a defense for sampling, but court decisions in later trials pretty much overturned those precedents.

yea the law journal is currently editing it and I was also writing my own paper for publication and doing an entertainment law competition so that is on my professor haha. Plus, I am not sure if that was even the edition sent to the law review, just figured some blue schoolers would want to read it
